About these terms
These Terms of Service govern use of the SeriousPlay Games website at seriousplaygames.com and seriousplay.games, including their www subdomains (“Site”). The Site is operated by SeriousPixel, LLC, a Tennessee company doing business as SeriousPlay Games (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please stop using the Site.
If you use the Site on behalf of an organization, you represent that you are authorized to act for that organization. A minor should review these Terms with a parent or legal guardian. Adults are responsible for communications they submit on behalf of children.
Informational website and future products
The Site introduces our studio, philosophy, and possible future games. No games, accounts, paid services, or subscriptions are currently offered through it. Concept art, illustrative examples, Skill XP descriptions, and other forward-looking material describe intentions and possibilities, not currently available functionality.
Titles, features, platforms, pricing, and release timing may change or may not be released. Nothing on the Site is a binding offer to sell a product or a promise to deliver a particular feature. Future games, purchases, and online services may be governed by separate terms presented when those services become available.
Descriptions of educational goals are statements of design intent. We do not guarantee specific learning, academic, career, or other outcomes. Skill XP is not an accredited qualification or a substitute for an educational assessment.
Ownership and permitted use
The Site’s text, branding, logos, artwork, design, and other materials are owned by SeriousPixel, LLC or used with permission, except where otherwise identified. They are protected by applicable intellectual-property laws. No rights are transferred to you by accessing the Site.
You may view the Site and make reasonable personal, noncommercial copies of publicly available pages with copyright and attribution notices intact. You may link to public pages without implying endorsement or affiliation. Any other reproduction, distribution, adaptation, commercial exploitation, or use of our trademarks requires our prior written permission unless allowed by law. Rights arising under fair use and other statutory exceptions remain unaffected.
Acceptable use
You must not use the Site to violate law or another person’s rights; attempt unauthorized access to systems or data; introduce malware; interfere with security or availability; impersonate another person; or use automated requests in a way that unreasonably burdens the Site. Ordinary search-engine indexing and lawful accessibility tools are permitted.
Do not submit unlawful, threatening, infringing, or deceptive material through channels linked from the Site. We may restrict access when reasonably necessary to prevent misuse, protect the Site, or comply with law.
Inquiries and feedback
Our contact form sends inquiries to SeriousPixel, LLC, using DigitalOcean and our email delivery provider. You are responsible for ensuring you have the right to provide information included in your message. Do not submit confidential business material, sensitive personal information, or children’s personal information through a general contact inquiry.
You retain ownership of material you send. You authorize us to use your inquiry as reasonably needed to review and respond to it. If you voluntarily provide suggestions for improving our products, you permit us to use those suggestions without payment or an obligation to implement them. This does not give us ownership of your unrelated intellectual property or override a separate written agreement.
Privacy and external links
Our Privacy Policy explains information practices for the Site. Other websites linked from the Site may have their own terms and privacy practices. A link does not by itself mean we endorse an external site or guarantee its content, availability, or security.
Availability and disclaimers
To the fullest extent permitted by law, the Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that all information will always be accurate, complete, or current.
We may correct, change, suspend, or discontinue Site content or features. These disclaimers do not exclude warranties or rights that cannot lawfully be excluded.
Limitations of liability
To the fullest extent permitted by applicable law, SeriousPixel, LLC and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, or business opportunity, arising from use of or inability to use this free informational Site.
To the extent permitted by law, our aggregate liability for claims arising from this Site or these Terms will not exceed US $100. These limitations do not apply to fraud, willful misconduct, gross negligence, or other liability that applicable law does not permit us to exclude or limit. If your jurisdiction does not permit a limitation described here, that limitation applies only to the extent permitted.
Governing law and disputes
These Terms are governed by Tennessee law, without regard to conflict-of-law rules, except that mandatory protections under applicable consumer law remain in effect. Subject to those protections and applicable jurisdictional requirements, disputes relating to the Site or these Terms may be brought in state or federal courts of competent jurisdiction in Tennessee.
We encourage you to contact us first so we can try to resolve a concern informally. These Terms do not impose mandatory arbitration or waive any nonwaivable right to pursue a complaint with a regulator or a claim in an appropriate court.
Changes and general provisions
We may update these Terms by posting a revised version with a new effective date. Updates apply prospectively; where required, we will provide additional notice or obtain agreement. The version in effect at the time of a dispute will govern that dispute to the extent required by law.
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms are the entire agreement for use of this informational Site and do not supersede a separate written agreement covering other products or services. Provisions that by their nature should survive the end of your use, including ownership and lawful liability limitations, will survive.
